City Attorney David Chiu files City and County of San Francisco and the People of the State of California v. Qwick Inc. (SF Superior Court, Case No. CGC-23-608756), alleging Qwick illegally misclassified servers, bussers, dishwashers, bartenders and event staff as independent contractors — denying overtime, meal and rest breaks, health expenditures, and paid leave. Chiu: “Qwick is inequality disguised as innovation.”

Scottsdale worker LaTiesha Baker: two deductions, $800 and $2,000+ — $2,836.60 total, leaving her account negative and triggering overdraft fees. Her sister’s bank flagged a $1,200 attempted withdrawal. Support responded with automated messages only. “We have bills, families, and responsibilities. It’s not right.”

If money was pulled from your account (like the Nov 2025 Stripe glitch), dispute it as an unauthorized transaction immediately. Ask for provisional credit. Deadlines are short — usually 60 days.
File a wage-theft complaint with the Wage and Hour Division if you believe you were misclassified or not paid. Free, confidential, and they can investigate for you.
Every state AG takes worker and consumer complaints. California’s Labor Commissioner runs a free wage-claim process; other states have equivalents. Strongest state-level lever.
Qwick is NOT BBB accredited and holds an F rating with 16 unanswered complaints on file. A new complaint adds to a public, dated record the company is already failing to answer.
Report deceptive payment practices, sudden account withdrawals, or data/privacy failures to the FTC. Reports feed federal enforcement patterns against gig platforms.
For owed pay under your state’s limit (commonly $5K–$12.5K). No lawyer needed, filing fees are low, and you can recover them if you win. Bring your shift records and support emails.
If Qwick’s bankruptcy proceeds, wage claims up to $17,150 earned within 180 days of filing get priority status. Miss the bar date and you may lose the right to payment. Act fast.
